Raging Judge Update
ATF says no to the raging judge and the lever action 410 pistol from Rossi, says Gunblast (at end of video):
Stay tuned. Could be the shotgun ruling? Though not imported.

Would 3 gun competition count as a sporting purpose?

Wait, Taurus has actual production facilities in the US now? I figured they imported all their receivers and frames. Huh.
But anyway, if Taurus really didn’t do anything to make this a “sporting” pistol, then their entire legal department needs to be fired pronto. Major league incompetence there.

It’s not a matter of sporting or not, it’s a matter of it being either:
-a shotgun which is under 18 inch barrel length/26 inches total length
-a smoothbore pistol
-a pistol with caliber over .50
No matter how you slice it, a 28 gauge pistol is an NFA weapon.
The only reason the 410 gauge pistols aren’t NFA items is because they’re under 50 caliber, chambered in 45 long colt and have rifled barrels. This makes the 45/410 judges non-big-bore-dd, non-shotgun, non-smoothbore pistols.

Another way to explain it is:
-the 28 gauge pistol has a bore diameter over .50. This makes it a DD unless it is a sporting shotgun.
-if the 28 gauge pistol is a shotgun, then it’s a short shotgun even if it is particular suited for sporting purposes
-the only way you could get it out of being a DD is by claiming that it more appropriately fits under smoothbore pistol category of AOWs.
The only real way to have big bore pistols is by changing the DD law so that it isn’t so broad.

Jim,
Thanks, I know the NFA. Though you may want to recall that a shotgun has to be fired from the shoulder, so a pistol cannot be a shotgun. This gun is either an AOW or a DD.
What I meant was, if they couldn’t come up with a workaround, like making the land-to-land measurement under half an inch, then they should never have tried to bring it to market. That’s wasting the owner’s money, if the owners care about that. If their lawyers signed off on it, they’re incompetent.
(That would not be the case if it were part of a considered legal strategy to challenge the current laws. But I doubt that’s the case here.)

I suspect it’s a way to grab attention at SHOT. I only really follow it through the blogs, but I think I’ve heard more about Taurus’ offerings (and I’m including the S&W Governor here, as it points right back to Taurus) than all the rest combined except Kel-Tec.

The ATF still sucks.

How about burn down the ATF and repeal the NFA? I like that solution better.

“The ATF still sucks.”
They have a billion-dollar-a-year budget. We buy a billion dollars worth of suck from them every year with our tax dollars. We should spend the money elsewhere.
