I see the following flaws in his argument:
1)No one has sued to take the Athena down to my knowledge. Someone has to actually challenge it in court if memory serves.
2)As with “In God We Trust” and references in the Pledge of Allegiance, the courts have held that rote repitition reduce the religious significance of those statements. Had someone challenged the Pledge shortly after it was changed to include “under God”, they might have been successful in changing it. The Athena has been there 100 years and thus loses its religious context.
