You don’t need no stinking property rights
Ain’t that America! Old buildings are more important than your right to enjoy your property:
Reversing a lower court decision, the Tennessee Court of Appeals ruled Wednesday that Cherokee Country Club cannot tear down an 87-year-old mansion on its Lyons View Pike grounds.
The three-judge panel unanimously found the city’s historic overlay ordinance, which calls for a 180-day moratorium on demolitions in areas under consideration for historic zoning, functions more as a building code than a zoning regulation.
Note to all you historic preservationists: Eventually everything will be old.
