Your pro-gun president

The Justice Department is asking the SCOTUS to overturn the Ninth Circuit’s ruling that said the Feds had no authority to regulate homemade machine guns, which I discussed here.

Update: Since the Congress and the Executive Branch have acknowledged an individual right to arms, this could be a vehicle for the Supreme Court to do the same. However, I wouldn’t count on it.

    Didn’t the original NFA only apply to interstate commerce of machine guns, sawed-off shotguns, etc? In other words, you only had to pay the tax when you wanted to transfer the firearm.

    Anyway, as you say, we ought not count on a decision going our way.

    I hope your not serious. Obviously, I’d like to see SCOTUS recognize an individual right to bar arms, but this would be a really bad precedent. Right now, I’d imagine that the executive and Congress agree on a lot of things that aren’t the slightest bit Constitutional specifically relating to separation of church and state.

    Note that the petition cites another SCOTUS case regarding victimless crimes, Ashcroft v. Raich, medicinal marijuana, and that the DoJ understands clearly that similar logic applies to both cases. If RKBA wins, the War on Drugs stands to lose big. That is probably what is motivating DoJ to petition even if they are nominally pro-Second. They’ll happily ditch the Second Amendment if that means they can continue to prosecute the War on Drugs.

    So who here is still pleased-as-peas to have the GOP in control of all 3 branches of the government?
