DETROIT – A federal judge has ruled that the Bush administration’s warrantless surveillance program violates the Constitution.

I can see the Bush administration quivering in their boots — not. Bush’s Department of Policy Enforcement (previously known as The Supreme Court of the United States) will take care of the nuisance in due course.

Storm: That might be funny if the Supreme Court actually did do whatever the President wanted. Given their decision in, say, Hamdan, what you said simply doesn’t make sense.
I also don’t expect this decision to last, but that’s because I don’t see any good legal grounds for it, though since there’s no details of the decision that analysis can change… (Free speech grounds to strike down a wiretapping program? That must be an… interesting argument.)

I think SM’s right. This decision is far too wacky to stand up on appeal, or even to serve as a serious argument against Republicans between now and election day. The most it can accomplish between now and November is to remind voters which party is serious about protecting national security and which one is actively trying to undermine it.
