Osama’s Arms Market
We’ve been lead to believe that Osama has been in Pakistan. Personally, I think he’s a stain on a cave somewhere. But an intrepid individual in Florida has managed to pin him down:
In a few weeks, the gun show at the South Florida Fairgrounds will be an ideal event for all violent criminals to attend. At these shows, there is a gun show loophole in the law that allows them to buy guns from other private individuals without any documentation or paperwork. Even a person like Osama bin Laden would have no problem purchasing automatic and semi-automatic weapons.
Congress has been trying to close this loophole for years, but the National Rifle Association has made sure none of these bills passes. Some states have closed the loophole. Florida is not one of them.
Emphasis mine. Except that there is no private sales of automatic firearms in the United States, and that automatics are heavily restricted. This guy also mentions that some states have closed the “gun show loopholes”. My home state of Pennsylvania is one of those states that has done it for handguns, and as anyone who has followed Philadelphia’s murder rate will tell you, it doesn’t work.

Actually you can privately buy a machine gun from a resident of your state without a dealer being involved.

No, you can’t. Machine guns have to be transferred through a Class III SOT and FFL.

I saw Osama just the other day. He was sitting at a Starbucks with some people who were obviously Democrats. They were bashing Bush, and saying that we should pull out of Iraq and Afghanistan immediately. Osama was just playing with his beard and nodding. They bought another coffee for him. He seemed to be in agreement with them, but he kept his Krinkov on his lap and he kept looking at his watch.
As for the “gun show loophole”, the anti-gun rights crowd just wants to get that out of the way so that they can move onto the “private sales loophole”. They want ALL transactions to go through an FFL, so that they can then start restricting the transactions by making some guns “nontransferable”, meaning you have to turn it in to law enforcement if you don’t want it anymore. Then they can work on making the list longer and longer. It’s a “progressive” thing.

That assumes facts not in evidence: that the intention was to lower the murder rate. Seems more likely to be just so “they” know who has the weapons.

But Congress only has authority over interstate commerce. How could they pass a law prohibiting the transfer of a Class III firearm within a state?

Because FDR decided that Congress should be able to regulate everything, and packed the court with people who agreed with him.
But even absent that, the NFA is a tax provision. If you transfer a machinegun without paying the tax, you’re still guilty of tax evasion.

Two residents of the same state can transfer a Title II firearm from one to the other without the help of a SOT. It is a form 4 to form 4 transfer. They submit a form 4 directly to ATF. A form 3 transfer thru a SOT is not required.

I misunderstood what you were saying, but I wasn’t aware you could do that regardless. Either way, the NFA bites again. No matter how many times I think I understand that part of federal law, I always find little pieces I didn’t know.

I would suggest that a person like Osama bin Laden really would encounter some problems trying to purchase a gun at a gun show.
In fact, I would pay good money to be the one to meet him there.
