Hardy on Heller

Over at GOP USA.

One Response to “Hardy on Heller”

  1. teqjack Says:

    Even Counsellor Hardy misses one big point when he says a “semiautomatic rifle” may be calssed as a “machine gun.” So can semiauto pistols.

    Machine gun” means any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot:

    (A) Automatically, more than 1 shot by a single function of the trigger;

    (B) Semiautomatically, more than 12 shots without manual reloading.

    So, any firearm which can possibly be altered “readily” (by inserting a magazine…) to fire more than twelve times without re-loading is a “machine” gun, indistinguishable from an electric minigun. In other words, any semi-auto at all. Think your seven-shot is exempt? Not if someone with the skillset of a “Carbine” Williams could construct a mag/clip/extension of eleven (plus one chambered) or more. There are 15-capacity magazies for the 1911 available (if not all that practical) – or how about the government-issue 30-round “snail drum”” for the Luger?
