Virginia no longer honors Tennessee Handgun Carry Permit? Well, crap. I’m spending Thursday night there.

I tried to post this on “Walls of the City”, but haven’t registered there yet.
This was noted in Virginia in May; a VCDL Alert included the following:

If you live in Virginia, but work in Tennessee and carry a gun with a
Virginia CHP, please read.
Virginia and Tennessee used to have a written reciprocal agreement to
recognize each others CHPs. Tennessee told Virginia that they could
not find their copy of that agreement and suggested each state simply
recognize each other’s permit unilaterally.
That sounded like a reasonable idea, as one would think that nothing
would really change.
WRONG.
It turns out that Tennessee has a provision in their law that says if
you live in a state that does NOT have a written reciprocal agreement
and you work in Tennessee more than 30 hours a week for more than six
months, then you MUST get a Tennessee CHP in order to carry there!
I just got off the phone with Tom Lambert of the Virginia State Police
and he is going to be checking into this ASAP. I will advise as soon
as I hear back.

Sounds like Tenn. either needs to find the agreement, or a new one needs to be signed.

Unc, you could always open carry. I realize that may not be an optimum solution, but it’s at least something you could consider.

Sorry about the registration – it is my limited attempt to defeat spammers. I cannot believe the two states would not just work this out, instead of striking TN from VA’s rolls…

I remember the VCDL alert but that was regarding Virginians carrying in TN. I was not aware about the issue of Virginia removing Reciprocity with TN. I just e-mailed Phillip to see if he has any info about what’s going on.
As Boyd said, Open carry is perfectly legal without a permit. Being hassled about it is rare, but not beyond the realm of possibility.
In Virginia, you cannot carry in K-12 schools, in Churches while services are being held, Commercial airport terminals (even the “non-secure” areas), In jails, prisons or courthouses, On private property where it is posted or if management asks you to leave. Also, only permit holders can carry in state parks (even openly)…that’s it. Of course federal laws apply (Post Offices, National Parks, Etc). It is also illegal to carry a firearm while intoxicated or while in possession of illegal drugs.
Carrying concealed in an establishment that serves alcohol is also prohibited, but open carry is permitted (don’t ask me, I didn’t write the laws, I’m only reporting them).
Virginia has complete preemption so you don’t have to worry about running afoul of local ordnances.
That’s about it. I’m not as familiar with North Carolina laws so once you cross the border you’re on your own.

Unc – Check VA statute 18.2-308; open carry is legal everywhere firearms are allowed in Virginia as long is the gun is “open to common observation.” Easy to do in summer, less so in winter.

The lack of a Reciprocity agreement with VA is NOT the full story on whether or not a TN resident can carry in VA.

There are 15 other states that do not have Reciprocity agreements with TN but DO recognize TN HCPs.
PS, I was carrying in VA all weekend but have no idea if I was legal?
15 states DO NOT recognize the TN HCP (well 16 if VA ends up being included)

I got confirmation from Phillip.
It appears that this is nothing more than a technical issue and not an intentional “dis”.
Tennessee seems to have “lost” their copy of the agreement. Since they don’t technically have a written reciprocity agreement with Virginia, they dropped the agreement. Not a big deal for Virginians because TN recognizes any other state’s permits.
However, VA requires an agreement. Since TN dropped VA, VA automatically dropped TN.
The problem is being addressed and I don’t know what’s taking so long (this has been going on since at least May). Not much help for you, but there it is.
BTW, we’ve been trying to get unilateral reciprocity passed in VA for a while now but can’t seem to get it out of committee.

Looking at the VA page that is similar to the TN page I referenced above, it shows some states that have Reciporocity agreements and a list of other thats that VA has mutual recognition. TN is not on either list.

All things considered, RedDog, were I to go to Virginia, I think I would believe the rules listed on their webpage as opposed to the Tennessee page. Just because TN says VA does, that does not mean VA has to.

That’s how I read the VCDL update when I first saw it – even though it focuses on the Virginians in Tennessee situation.

Be careful of the restaurants. CC in an establishment that has a ABC license to sell alcohol on the premises is a misdemeanor – however, OC in the same establishment is perfectly legal. Don’t comply with a “Hey, cover that up” in such a place as you’d then be breaking the law.

As of the time of this comment, Tennessee is back to being listed on the Virginia Sheriff’s Department webpage. Let us hope they do not lose the paperwork again.
