Gun suit in Cali

SAF reports:

The Second Amendment Foundation, The Calguns Foundation and four California residents today filed a lawsuit challenging a California state law and regulatory scheme that arbitrarily bans handguns based on a roster of “certified” handguns approved by the State. This case parallels a similar case filed in Washington, DC, Hanson v. District of Columbia.

California uses this list despite a ruling by the U.S. Supreme Court last summer that protects handguns that ordinary people traditionally use for self-defense, and a recent ruling by the Ninth Circuit Court of Appeals that the Second Amendment applies to state and local governments. The California scheme will eventually ban the purchase of almost all new handguns.

    Yeehaw!

    This is truly a stupid, abusive Cali law. Handguns can be judged “unsafe” because of a simple cosmetic change, like OD green grips. “Unsafe” until 3 guns are submitted to the state along with a significant “fee”.

    This in a state where violent felons are kicked free because it is too expensive to put them in jails staffed by union jailers.

    Good on the SAF! I’m happy I joined. And there’ll be another check coming their way.

    There needs to be a way to hold irresponsible law makers accountable for neglect of duty or some such charge when they intentionally draft legislation which has been ruled unconstitutional. The extra expense created to hire legal council should be passed directly to these individuals in a similar manner to civil damages where the amount can be multiplied by two or three times as a cautionary to other useless twits.

    California’s gun laws are so grossly overcomplicated that they have resulted in many dealers on the Internet auction sites stating, “No sales to California”. If that’s not a “chilling effect”, then I don’t know what is. The intention of California’s viciously, anti-gun rights legislature with its contempt for the Second Amendment, was to achieve exactly that effect. California’s gun laws are grossly unreasonable. We need to change that.

    Chas, that would be interfering with interstate commerce. The Supreme Court says that’s a no-no. Heh.

    This list is done for one reason only, and that is to shake down the firearms companies with constant compliance taxes to sell guns in CA. There have been several companies whose products were allowed to sell in CA until they decided to stop making payments to the CA DOJ who then removed their products from the approved list and made it illegal to sell them in the state. It’s corruption and extortion by government, pure and simple.

    Only reason we can do this is because of the 9th Circuit’s ruling in Nordyke. Because of that ruling, we’re now able to bring suits to abolish the handgun roster, discretionary CCW issuance, and the AWB. Which means such things will be Constitutionally prohibited from ever being introduced in your state. So it’s in every gun owner’s interest to please DONATE to SAF or Calguns Foundation to help fund this string of lawsuits.
