I tend to think there’s less than meets the eye. After all, the last 9th Circuit case on guns, Silveira, all but conceded the incorporation issue by ruling that there was no individual right for Cali’s “assault” weapons ban to violate. If the Silveira court had thought that the Second Amendment (such as it was) did not apply to the states, they shouldn’t have reached that issue at all.
