What’s funny is that suppressors are legal in michigan (the laws says they’re ok if the feds ok it), yet the ATF will not approve the form for them. Its a huge political and legal mess.

But they aren’t regulating the airgun, they are going after the unregistered suppressor.
Of course, one cannot get the suppressor registered, since there is no firearm to go along with it.
Makes perfect sense from a bureaucratic mindset.
I believe this issue is covered under rule Catch-22.

Mikee, in order to have a suppressor, you must register it against a particular firearm? Even if it’s a screw on model that you might want to use on several firearms?

The full statute preempting state “prohibition” can be seen here: http://www4.law.cornell.edu/uscode/html/uscode15/usc_sec_15_00005001—-000-.html
Note that what is preempted is _prohibiting_ the sale of pellet guns to people who are not minors. It does not say that the state cannot classify a pellet gun as a “firearm” and “regulate” the sale of same — which appears to be exactly what the state of Michigan has done.

(d) “Firearm” means a weapon from which a dangerous projectile may be propelled by an explosive, or by gas or air.”
Check. The Whisper propels a projectile by air.
“Firearm does not include a smooth bore rifle or handgun designed and manufactured exclusively for propelling by a spring, or by gas or air, BB’s not exceeding .177 caliber. ”
It’s not excluded because it’s not smooth-bore, and it doesn’t shoot BBs.
It’s Rifled, and it fires lead (or alloy) bullets.
Where’s the confusion?
