Modification of the rifle to accept detachable magazines may be an issue here but it is not a defense unless it can be shown that the magazine holds/feeds the cartridge at a different angle than the original fixed magazine. If the original feed angle would have prevented the discharge Norinco could use this as a defense; if the feed angle did not change, the plaintiff could use this to counter the “modified rifle” defense.
Dumbass? Maybe, but consider that while the SKS with the original magazine could be unloaded by opening the magazine from the bottom, not all rifles allow this. For example, the M1 Garand by design cannot be unloaded except by action of opening the bolt.
Suing Norinco 20 plus years after the rifle was sold: now there’s a dumbass.

Statute of limitations? PLCAA? common fricking sense? Nope, a lawyer out to get a buck.
(Which is the same thing I said when Firestone got cluster-sued; the replacements I had to get for my Ranger were decidedly crappier).

I got seriously curious, and went and played with my Norinco SKS for an hour or so this evening.
With my 20 round fixed mag, they feed above the center of the chamber. The same if I take it out and put a cheap and crappy aftermarket mag in there.
(Hey….I said it took an hour! I was curious, so I tried it. Farging duckbill detachables suck stagnant swamp water. I wouldn’t use them, but I’ve been in the SKS business since about ’94. And I never part with much of anything. Probably dumb, but there it is. They still feed above the centerline.)
I don’t have an AK mag accepting model. I’d buy one, if it came my way, but the AK’s are enough, even though I figure on a minute of arc more from my SKS’s, just because of the barrel length increase.

Besides all that, how in the flop do you get your chamber so gunked up that the round won’t extract? Unless it short stroked, then the following round rolled down off the top rim of the first one, it seems a bit problematic to me.
At any rate, if he didn’t drop the mag before he started yanking, it’s all on him, the way I see it. It’s not idiot proof, and sadly, someone manages to out-idiot any and all idiot proofing anyway.
How many cops shoot themselves with Glocks? OK. I’ll shut up now. But this lawsuit is going nowhere, unless they get the Brady Campaign on the jury.
