I would say no, that NICS can be used by any government agency that wants to use it. That’s why those law enforcement agencies were running bc’s – they had permission from NICS to do so. An access code from NICS is required to use NICS and they don’t just give an access code out to anyone who wants one.
My county clerk runs a NICS check on anyone who applies for a pistol license amendment. It’s noted on my amendments.

whether or not they had permission from NICS to do so, doesn’t make it any less illegal. It is illegal. NCIC is the proper resource for the policing agencies to use. NICS is limited, by law, to use by FFL’s.
