Declan McCullagh:

A New Jersey appeals court has concluded that Americans have no Second Amendment right to buy a handgun.

Whoa! That goes against Heller. Oh, that’s right, they didn’t exactly rule that. What they actually ruled was that NJ’s onerous licensing scheme (which can deny you a firearm because some police chief doesn’t like you) was not affected by Heller. And noted that Heller did not strike down a gun ban but told DC to give a permit. Seems to me that requiring the permit did end the ban.

This is one of the issues with Heller. The Heller team wanted a win on the simple question of whether or not there is an individual right to arms. As such, the case was very narrowly focused. And pretty much opened up all sorts of room for legal maneuvering. I think once the Chicago case is concluded, this will change.

Yes, Heller was a win. But there’s plenty more to be done. And smart guys like Alan Gura are doing those things.

And why we follow them. Yes, you can make mistakes (I have) but in order to really ruin your day or someone else’s, you have to violate more than one of the rules. In other news, Rich is blogging again.

Private contracts are still private

A lot of folks seem upset with the recent TN AG opinion that says a landlord can ban firearms on his property. Well, it’s the landlord’s property and so long as a tenant agrees in the contract or such a requirement is in the rules the tenant agrees to abide by, then that’s a matter of abiding by a contract. If you sign such a contract, you are bound by it. I can’t imagine many people would sign such a contract.

Looking at ten years in prison and a $250K fine for missing three inches of steel:

James Mathew Kennedy, of the 1000 block of 27th Avenue Southwest, took the AR15-type rifle into the gun show, where he went to buy parts, officials said. They gave this account: The rifle had a barrel length about three inches shorter than is allowed without first going through a lengthy federal approval process.

Barrett May Move?

At the NRA convention, I met Ronnie Barrett of Barrett Rifles. Nice guy. This article says he may move the company out of state due to issues with the Tennessee Department of Transportation:

Barrett wants to widen Miller Lane and extend it by 550 feet, at no cost to the city or county.

Barrett says 4 years ago TDOT agreed to the project, but later changed its mind about allowing use of the public right of way along I-24.

He says, “They responded in writing, yes we’re in favor of this. The fence could be moved so the extension could go forward.”

FOX 17 asked TDOT for a comment but since a lawsuit has been field, state officials say they can’t comment on pending litigation.

Barrett recently completed a $4 million expansion, believing TDOT would allow the roadway extension.

Without it, the building isn’t accessible to commercial vehicles.

Gun owners, that is. This post at Tam’s got me to thinking. Imagine if your local gun shop was ran like an internet forum.

Customer: Yes, I’m interested in buying an AR-15?

Gun Shop Person: I don’t carry those. They’re overpriced, finicky, and the round won’t even stop a small kitty. I carry AKs. You can fill the action with concrete then just add some motor oil for lube and it will fire. And it fires a man’s round!

Customer: But the AK has horrible ergonomics, the receivers are pounded into creation by cavemen with rocks and you couldn’t hit the side of a barn from inside the barn with one.

Gun Shop Person: Gamer

Customer: Cheapskate

**Pause**

Customer: Got any Glocks?

Gun Shop Person: Don’t even start.

Oddly, despite the internet’s various and sundry ABSOLUTE TRUTHS ABOUT ALL THINGS GUN, I’ve never had a gun shop employee try to talk me out of a gun. Unless they just didn’t sell it there.
