I read an interesting argument about the notion of “equal rights” with respect to gay marriage. Goes like this: gay people already have equal rights, as a gay person can still legally marry any willing person of the opposite sex. Just because they don’t want to does not necessarily mean that they don’t have equal rights.
Suppose someone wants to marry his own mother. He can’t do it. Does that mean he doesn’t have equal rights? I can’t marry Morena Baccarin whether I want to or not, on account of I’m already married (among other reasons). Does that mean I don’t have rights equal to some other slob if he gets to marry her?
Whatever it is, it’s not a matter of equal rights. We all have the same rights in this country, except for government officials, who seem to have more.
For the record, I’m not arguing here against gay marriage, I’m simply saying that it’s not an equal rights issue. Now if I was deprived of the right to vote on account of my hair color, that would be an equal rights issue, because there is such a thing as a right to vote that is bestowed on everyone else who is 18 or older.

In 2012, we’ll have a new election policy: you can only vote for Barack Obama. Note that there’s no equal rights issue here–you’ll have the exact same right to vote for Barack Obama that everybody else does. Just because you don’t want to doesn’t necessarily mean you don’t have equal rights.
Also from that point on, Americans will only be allowed to practice Islam. This isn’t an equal rights issue either, because everybody will have the exact same right to worship Allah and his Glorious Prophet. Just because you don’t want to doesn’t necessarily mean you don’t have equal rights.
Finally, the only restaurants allowed to operate will be smoke-free vegan coffeehouses. This isn’t an equal rights issue because every entrepreneur will have exactly the same right to open a smokefree vegan coffeehouse. Just because you don’t want to doesn’t necessarily mean you don’t have equal rights.
… Or _maybe_ the “it ain’t unequal ’cause you could marry a girl” argument is just frivolous.
The problem with both Ben and elmo’s points are that this really isn’t an equal rights issue at all. Anyone in the US is free to marry anyone, regardless of your or their reproductive equipment. It’s not illegal anywhere. That was decided (rightly, IMO) in Lawrence. What the push is now is to extend the state’s recognition and subsidy of het marriage to SSM.
Now, the libertarian in me feels that this is the wrong direction. We should get the .gov out of recognizing and subsidizing marriage at all, and leave it as a religious function.
