An overwhelming majority of congresscritters come out on the side of truth, justice and the American way:

An overwhelming, bipartisan majority of members of the U.S. House of Representatives and the U.S. Senate have signed an amicus curiae, or “friend of the court,” brief supporting the NRA’s position that the Second Amendment is incorporated against the states through the Fourteenth Amendment. The amicus brief, bearing the signatures of 251 Members of Congress and 58 Senators, was filed with the U.S. Supreme Court today in the case of McDonald v. City of Chicago.

Police arrested a vice president from Bieber’s record label, Island Def Jam Records, saying he wasn’t cooperating with attempts to disperse the crowd.

James Roppo, 44, of Hoboken, N.J., was charged with a series of misdemeanors, including endangering the welfare of children and obstructing governmental administration.

“We asked for his help in getting the crowd to go away by sending out a Twitter message,” said Nassau County Police Det. Lt. Kevin Smith. “By not cooperating with us, we feel he put lives in danger and the public at risk.”

More on the TN Restaurant Carry Suit

I’ve talked to a few folks about the results of the suit. Of the 4 legal types I’ve talked to, three say that it’s likely not applicable state wide. One says it might be. Only enforceable in the county since a chancery court is a local court of equity. And, apparently, if it is appealed and held up by an appeals court then it would likely be statewide. So, can you carry in a restaurant that serves alcohol? I’m not sure. Seems there’s a case made either way. And if you err, you may want to err on the side of caution. After all, the TDOS has said the law is null and void.

Some are arguing that striking the law down means guns removes the misdemeanor penalty and, in essence, makes carry everywhere peachy.

Regardless, it looks like the AG will appeal and that the TN general assembly will fix it.

Guns and libraries

Local libraries reiterate their no gun policy.

We were told that the Protection of Lawful Commerce in Arms Act would prevent lawsuits against gun makers if their product was defective. So this case of a man shooting himself due to a defective transfer bar winning his suit could not have happened.

So, it’s looking like the global warming crowd has been a bunch of very naughty boys. Someone hacked their computers and released some unflattering things about them. If this stuff is true, then it shows a pattern of:

Suppressing dissent by attacking the unbelievers.

Using peer review for political reasons

Threats of violence against heretics err dissenters.

Data manipulation of keeping some stuff private they don’t want out. And manipulating it to make the point they want.

Legislators already saying they’ll fix it. I dunno. Doesn’t look like it would stand a court challenge to me. But I’m no lawyer.

On the Restaurant Lawsuit

People are asking me if the chancery court has jurisdiction over the whole state. I don’t know. Researching and asked a few of my legal correspondents and am awaiting an answer. Being a court of equity that settles disputes, this makes little sense.

Update: According to a former judge acquaintance, this ruling is not applicable anywhere but the county. Unless it is upheld by another court (which it won’t be), then it becomes case law.

Update 2: The TN Dept of safety advises that it is not the law anymore. Not sure if that’s an interpretation or some sort of ruling. So beware out there.

Restaurant Carry Lawsuit

WizardPC notes the ruling went the other way. I don’t see how this ruling will stand. Seems that they presumed the onus of knowing restaurant laws was on permit holders. Bonnyman’s ruling is pretty asinine. I mean, it’s easy to tell if a restaurant serves food five days a week. They usually 1) have food and 2) post their hours of operation. Looks pretty weak.

Aiming for Liberty

I received a copy of David Kopel’s new book Aiming for Liberty yesterday (you can pre-order at that link). It’s a look at civil rights in general and, specifically, second amendment rights. I’m but a few pages in and note that the book picks up on the bigotry against gun owners angle. Quote in reference to the DC voting amendment which had the pro-second amendment bill attached, causing DC to ask the bill be pulled:

In other words, the DC government is so prejudiced against gun owners that the government would sacrifice voting rights for DC citizens rather than permit those citizens to exercise Second Amendment rights.

Starts today. Suit is kinda stupid. But WizardPC will try to blog about it if he can.

Lies and the watch list

The anti-gunners are parroting the lie that the Fort Hood shooter was on the terror watch list. And if we restricted those on the list (a list of millions that only shows name and has no appeal process) then the shooting would not have happened. Well, presuming he couldn’t get his hands on an illegal weapon. Anyway, it’s not true:

Three senior investigative officials, who insisted they not be identified by name because of the sensitive nature of the ongoing federal investigation, told reporters in Washington that Hasan was never nominated to be on a watch list. He was able to purchase weapons legally and had done nothing to justify even a preliminary investigation, they said.

He also had a security clearance:

In addition, Hasan had a security clearance at the “secret” level and received good performance reviews, they said. Nonetheless, they continued to examine his communications with the cleric in Yemen for several months as a precaution.
