Speaking of stupid arrests
Woman videotapes and photographs pictures at a surprise birthday party. Is arrested and charged with a felony because four minutes of a movie are playing in the background.

I’m beginning to wish that the Founder Fathers had included a clause in the Constitution (or, more likely, the bill of rights) to the effect of “no person shall be convicted of a crime without the prosecution having demonstrated mens rea beyond a reasonable doubt”.
Basically, require that the prosecution show beyond a reasonable doubt that there was intent to commit a crime. No strict liability at all.
At least for any crime that carries anything other than a nominal fine only

I do believe that the Disney (Eisner, actually) Extension to the copyright law is blatantly unconstitutional. When I think of the RIAA and the MPAA, I can’t help myself from thinking immediately afterward, “Git A Rope!”
(Oh, and don’t get me started about DMCA!)
