The cop who got on facebook and advocated shooting open carry activists is now national news:
Gun rights advocates have a California police detective in their crosshairs after he apparently posted comments on Facebook advocating that “open carry” supporters should be shot.

First amendment rights do not cover threats. He already state that he does these things on the job so why are the even mentioning his rights? (Does anyone seriously believe one day he just decided to start being a prick? No that take years of hard training.)
It is a CYA job. The department has a loose cannon, and probably has known about it for quite some time, but chose to ignore it. Now that policy is coming back to bite them in the butt. So they must procede carefully to avoid being implicated for negligence. Things like this are any policing group’s worst nightmare. Being found out.

Seems to me like justifiable self-defense should a person carrying openly come across him (on the part of the person carrying openly).

“In no way are his personal comments reflective of any policies or procedures here at the department nor does he speak for the police department,” Estelle told the newspaper.
Of course, Capt. Estelle wears an identical uniform, carries and identical badge and exercises identical police powers while working for the same agency as his brother officers, including Det. Tuason. It’s not like any sort of “us versus them” mentality has crept into the culture of modern law enforcement, nor is there any reason for anyone to mistrust the police. I’m sure it’s just one guy’s harmless, silly, offhand comments on a Facebook page, nothing more than that.
(Now, move along… “civilian.”)
The task of reforming law enforcement is probably a lost cause from the outset. Still, kicking this guy to the curb would at least be satisfying to watch.

If I were an attorney that has ever had a client who has had force used against him by Det Tuason, I would be taking a serious look at a lawsuit.
This guy is a legal liability to his department. Any arrest he makes from this day forward, and that statement will come back to haunt him.
