The line between felony and misdemeanor is one Day. The muster for a felony offense is 1yr or more sentancing, a misdemeanor is a max of 11 mos 29days. I think the whole “felony”thing is way over done and way to intrusive to its ends. In the old days, it didnt matter what the conviction was, once your deabt to society was payed, you were made whole again and they would very often, even return your guns and give you starting money and/or a new suit. The idea was to give you a fresh start. Now it follows you the rest of your life. It is just my opinion, but it is a well informed constitutionally sound one, that if you have done something bad enough to loose your gun rights and your right to vote, you should be swinging from a low tree branch. Other than that, when you have paid what you owe, you should be given a fresh start and all of your rights restored. Why would any convicted felon ever “go straight” when the process is going to hound them the rest of thier lives, they are pretty much doomed to crime once they are convicted. No one will hire them(not that there are any jobs anyway) and there is no light at the end of the tunnel. We have to show them why and how to change and let them. Someone who commits a really violent crime(rape, child molestation, murder, etc) should be HUNG, shot electricuted etc PUT TO DEATH and then the others have a nincentive to turn thier lives around. Why would any man in today’s society submit to trial? Assuming he wasn’t a criminal he has nothing to gain or preserve and a lot to lose, he might as well lose while extracting a price.
spook your right this has happened to me i drove a taxi cab in my town for ten years when i was hired they required that you have a clean driving record for the past five years then all of a sudden last year the transportation commission decreed that any public driver taxi, bus, schoolbus, trolley, towtruck, garbagetruck driver etc submit their entire driving history needless to say many people lost their jobs with out warning me included for an incident that occured nineteen years ago now my kids look at me funny
I also have been pondering the meaning of felons for many years. Never thought of myself as being a liberal but when it comes to how crime is prosecuted I surely become one. How can you take everything a man has but his life then when he has served his sentence you keep taking. There is no such thing as paying your debt to society. That is a myth that went with criminal rehabilitation. Rehabilitation only works if you let them change. If you do not and keep forcing their hand they will do something really worthy of jail. Our society is so civilized that once someone has been to prison they are seen as wild animals that cannot be trusted with anything. I may not trust them but that is no reason to let them know it every damn day. I had a cashier that had done 4 years in juve for breaking and entering and assault. He even smoked an illegal substance on his breaks “possibly”. He was a good cashier and did his job without stealing from us or the customers which is about all you can ask from a minimum wage clerk. Do you seriously think I held his criminal past or other bad habits against him. Hell no!He thought I was the greatest boss ever because I did not harass him for what he did on his time. If he would have done anything illicit on store time that would have been different. Oh yeah the stated article up there is one reason I never talk with cops. They cannot be trusted to not try to bust you for being friendly.
Rule number 1. NEVER talk to the police.
Rule number 2. At all other times, follow rule number 1.
I am retired LEO. I never would have believed it could have become what it has. To the point that I recommend and follow rules such as those above. If questioned by a police officer, properly identify yourself and then stfu!
