Well, at least he is an all around idiot. Doesn’t know about the scope’s use and doesn’t know that the only real issue is export control. There was no espionage. The scopes were on the US munitions list because they are scopes for firearms. They were also restricted because they were nigh vision technology. Any NV beyond Gen 1 is export controlled. A person lawfully in the United States bought items lawful to possess in the United States and crossed the border with them without an export license(s). They very well could have been planning on selling them to hunter, but it doesn’t matter since the export restriction is dependent on the end-use or end-user.
