Yesterday, I noted a case of someone being charged with making destructive devices and being treated like a terrorist for putting dry ice in bottles to watch them pop. Stormy draws our attention to another such stupid case:
Jimmy’s Old Town Tavern owner Jimmy Cirrito said his bartenders have been entertaining his customers — by juggling bottles of alcohol and spitting out streams of flames using matchbooks and lighters — for more than a decade and no one’s complained. But shortly after midnight on July 24, two of his longtime employees were hauled out of the Herndon bar in handcuffs and charged with three felonies each plus other misdemeanors
“They were being treated as if they were terrorists, charged as if they intentionally tried to burn down the tavern,” Cirrito said.
Fairfax County fire investigators charged Tegee Rogers, 33, of Herndon, and Justin Fedorchak, 39, of Manassas, with manufacturing an explosive device, setting a fire capable of spreading, and burning or destroying a meeting house. They also were charged with several state fire code misdemeanors.
An explosive device? Really. Where’s the explosion? More akin to a flamethrower and I don’t know about VA law but a flamethrower isn’t regulated federally.

I heard on the news this morning he was charged only with lying to the feds and not the other 20+ charges of being a politician err trying to sell a senate seat. They interviewed a juror who said everyone but one other juror was voting guilty but this one juror kept holding out. If I were an investigator of some sort, I’d be watching her bank account for any unusual deposits.

Some pros and cons that may come up in the courtroom. Seems too much to worry about to me. There are plenty of objective ways to convince reasonable people why an AR is appropriate, such as better stopping power, more accurate, and easier to control than a handgun.
The charges against Kaynor make him sound like he’s buddies with the Taliban. They include unlawful possession of a destructive device, five counts of unlawful manufacture of a destructive device and four counts of disorderly conduct. What did this Al Qaeda mastermind do? He put dry ice in soda bottles and watched them go pop in his backyard.
Not sure if Oregon law defines a destructive device differently but it seems to me that dry ice bombs do not fit the federal legal definition.
Authorities say a U.S. Springfield field grade M1 rifle was valued at $50,000 alone.
