This is actually a useful philosophic argument.
If I were to lock someone in my basement, deprive them of protection and allow them to beaten, stabbed and rapped, then I would be morally responsible and legally liable for their abuse.
Unless I call my basement a prison, then it’s totally different. I mean, they probably deserved it right…
Why is it we never hear about prisoners suing the government for the abuses they suffer while in prison?

Judges don’t want to know these kind of things. Because, we, the American public do not want to know these kind of things.
I have been an advocate for prisoners’ rights since 1984. Mostly, when I argue them, I get grief. Because people just don’t want to hear it. They have a view of the world they do not want disturbed.
It’s almost impossible to get in evidence of systemic prison rape in a 1983 (civil rights) petition.

In the run up to the Iraq war I remember being repeatedly being told that routinely allowing rape to occur in your prisons was a justification for having your country invaded and the government overthrown.

Cris the big hole in your argument is that prison rapes are not “allowed” to occur. Believe it or not there are actually human beings that work in these places that do give a shit and do what they can to try and protect the “weak” that are preyed upon. Unfortunately we can’t be everywhere at once and they do occur.

I attended a child rape trial earlier this year. He got convicted of every count and was sentenced to over 30 years and I hope he gets it just as bad every day for the rest of his life.
