Is that a mall ninja class I can take?

In Ohio, there’s a prohibition on taking guns into places where alcohol is served. The police can do it because they are better trained. Really? Trained to drink and pack?

The great thing about Ohio’s law is that it’s (by my understanding) legal for you to carry a firearm in a place that sells alcohol, UNLESS somebody’s drinking alcohol.

Theoretically, you could walk into an Applebees, look around the restaurant to confirm nobody’s drinking, then go back out to get your gun and sit down for a meal. Then, somebody orders up a brew, and the moment they touch the glass to their lips, you’re breaking the law.

Horrible law, which really makes me like Kentucky even better.

I like Indiana’s law, which says that you can carry.

It doesn’t matter if the place is serving alcohol for off-premises consumption. It doesn’t matter if the place is serving alcohol for on-premises consumption. It doesn’t matter if you drink alcohol at said establishment. It would probably not reflect well on you if you sparked somebody while three sheets to the wind, but that would be up to a jury.

Currently, Ohio law always a concealed carry permit holder to carry in any establishment that does not sell alcohol for consumption on the premises. So if the local “stop-n-rob” convenience store is selling beer, you can carry there – but if you go into an Applebee’s where alcohol is sold for consuption on premises – can’t currently carry there.

The new law would allow you to carry in Applebee’s, etc. as long as you did not consume any alcohol. Which is really stupid, because under current Ohio law, if you are carrying a gun concealed or otherwise anywhere and have consumed any alcohol – you are considered to have a weapon while under a disability – being alcohol.

But apparently the “only-ones” can drink and carry due to their training. You know, that class at the academy where they serve whiskey on the firing line at the range…

Sorry, first line should have said, “Currently, Ohio law allows a concealed carry permit holder…”

This weekend, Virginia’s law kept me from carrying for the first time (I’m a Marylandstan resident with no freedom, yet).

The VA law prohibits a person from carrying into an establishment that serves alcohol for consumption. The permit holder who is carrying is not allowed to consume alcohol while armed (which is senseless if you are having dinner and a beer, but it’s the law). Of course, that same law has carved out an exception for state and federal law enforcement officers. Go figure that it is acceptable to drink and pack with a badge.

Huh? Concealed carry in restaurants and clubs that serve for on-premises consumption has been lawful since 1 July of this year. You can’t drink but you can carry concealed.

If you want to drink, you can still open carry. Just like it has been since … forever.

TD is correct. Alcohol has to actually be served for a violation to occur. Also the law allows not only peace officers but any state employee who is authorised to carry weapons by the head of their department and who has qualified in the last 12 months to carry in licensed locations.

Remember, I do this to entertain me, not you.
