Yes and no. There are problems with the paper trail of assignments of mortgages but their lack of recordation is debateable as to its seriousness. The real problem that the lenders have hit in some states like Florida is sloppy or outright fraudulent affidavits supporting foreclosures – done by people who did not really do the work reviewing the files – but that’s a process issue not a substantive rights issue in my opinion.
I seem to remember Republicans telling me how dreadfully serious perjury is. So important that if someone to lie in court about something completely irrelevant to the question at hand (for instance a question about a blow job during an investigation into a real estate deal) that it constitutes a high crime and misdemeanor.
