In NJ

It’s illegal to break the law while breaking the law.

If there is a self-defense event and one is wearing a bulletproof vest during it, can one be prosecuted for the use of the vest before there is a conviction for charges for assault, etc.? Because if I had a chance to put on a bulletproof vest while someone was breaking into my home at 2am, and then the burglar got shot, I’d hate to get convicted of wearing the vest, then later get acquitted of shooting him.

You assume self defense is legal in NJ….

  3. SPQR Says:

That’s actually a very common statute in many states.

Correct, see e.g., Indiana Code 35-47-5-13, “Unlawful Use of Body Armor”.

So if you use a firearm in self-defense and “take cover” behind something hopefully inpenetrable in the process, is that illegal? Wouldn’t putting on a bullet-proof vest be taking cover?

When the process of self-defense of, by and for the people, is made illegal, we know that our government is being run by criminals and that our society has descended into barbarism.

    Ron….So what’s your point???

  7. JimB Says:

In New Jersey you can assume almost everything is illegal.. Except undocumented Aliens

  8. John Smith. Says:

I wonder if you can wear body armor while passing through new jersey if you do not stop for fuel???

    Yo dawg…

  10. Adam Says:

NH has a law like that too.

Maybe they came about after the North Hollywood shoot-out…

  11. Diomed Says:

Hell, it’s federal law too. I believe a recent case was appealed to the Supreme Court, though they denied cert…

  12. JKB Says:

In TN, they make it an offense for a whole slew of felonies

39-17-1323. Commission of certain offenses while wearing a body vest.

    (a) A person commits an offense who knowingly wears a body vest, when acting either alone or with one (1) or more other persons, while committing:

    (1) Any felony whose statutory elements involve the use or threat of violence to a human being;

    (2) Any burglary, car-jacking, theft of a motor vehicle, or arson; or

    (3) Any felony offense involving a controlled substance.

  13. Bob H Says:

From what I can see in a hasty search, in most states it is legal to own and wear a vest if you are not a felon, or commiting a felony. In some places you have to apply to state or local gov for permission to buy one, and in some places simple possession is illegal for non LEOs. WTF?! I guess you can’t travel with one.

Remember, I do this to entertain me, not you.
