“deliberate teasing would result in the (dog) responding aggressively and that response could potentially injure the (dog).”
See, this really doesn’t need to be illegal. The way it should have gone..
– Drunk barks at large, smart dog
– Large dog gets agitated, finds way out of enclosure
– Large dog gnaws on leg of disorderly drunk
– No charges filed. Problem solved itself.
Happened in Portland Maine. also IIRC the fact that it was a dog wasn’t taken into account. In Maine the K9 Units have a badge and are considered “Police Officers”.
So lets get this straight, if I say “Bark Bark” to a police dog I’ve committed a crime, but if a cop shoots my dog (and a mini van an a few houses) it’s justified for officer protection?

It’s a self-resolving problem. Protection dogs are trained to respond aggressively to threats to 1) the handler and 2)itself.
It’s a lot like that guy who used to commune with the grizzlies until one ate him. Play stupid games, win stupid prizes.
I imagine it’s illegal only to give the officer cause to arrest someone who is about to get mauled.

Yes, it’s a crime. It needs to be a crime so that when to police dog bites the jackass, it’s the jackass’s fault in the eyes of the law.

“The dog started it”
Now that is the best defense I have ever heard…

Everything is justified for officer protection. See also: No knock raids for simple possession and dealing orchids without the proper paperwork.
