The editorial seems to believe that only the proper members of the Fourth Estate should be allowed free speech? That’s a scary attitude.

The worst part of that article? That wasn’t the point! He was decrying the unwillingness to prosecute journalists for actual crimes because they raise a (bogus) 1A defense. His point would be equally applicable if a premeditated murdered raised a second amendment defense, and the headline and conclusion equally inapplicable.

People forget that a good bit of 1A jurisprudence results from people like Larry Flynt.
In the same way that most, but certainly not all, 4A and 5A law involves criminals.
