Update – Somebody emailed me to tell me that this is even more of an interesting story because this state law had been implemented back years ago and it was only now that some cities were getting around to changing their laws and ordinances to be in compliance.
Supposedly, now the state is actually going after offenders and charging officials with fines. Hmmm, now it’s clear why the sudden change of hearts.
And here I was thinking they didn’t need prodding…
Florida has had state preemption since 1987. Since that date, the state has had exclusive regulatory power over firearms. However, since there was no penalty for a local or county official who decided to ignore the law, many cities passed ordinances that were in violation of the law.
Earlier this year, gun rights organizations in Florida were successful in getting a law passed that not only punishes the local government for having such laws, but allows the politician or cop who enforces it to be prosecuted and/or personally sued for damages.
The press is calling this a “recent change in the law.” I say it is just holding government officials accountable for violating a law that has been in place and ignored for nearly 25 years.

The same thing is happening in Indiana. However, there are holdouts and they will be sued.
