Preemption does not cover waiting periods.

    That happened because of a change to Florida’s constitution that was on the ballot a few years ago. The southeast coast of the state is made up of retired liberals from New York and New Jersey, and many of those types of laws are popular there.

    Poor Bastards. And they’d have to change the State Constitution to fix it, also. PDB when Gun Laws seem to be looser up in Ohio. Longest I’ve ever had to wait to purchase a Firearm from a FFL Store was about 20 minutes, including the 4473 and the NICS check; the shortest was 3 minutes at a gun show. That doesn’t count the Shopping and the Haggling time, of course.

    I thought the law on preemption said any laws affecting firearms. A waiting period affects firearms.

    Waiting period is in their constitution. Laws can’t override constitution.

    That preemption most certainly does cover waiting periods. There’s a state waiting period if you don’t have a carry permit and localities may add an additional wait for non-permitees that is defined in the ballot initiative constitution change.

    If you make that permit longer than is allowed the preemption will kick right on in.
