    I tried to post this at David’s place, but it was rejected:

    The last time, she was openly carrying and got into her car and was driving away when cops stopped her, and illegally searched her vehicle and found the loaded pistol. Because the search was illegal, she won the lawsuit over the incident.

    This time, however, it is most likely a fight over the definition of “concealed,” as we have current case law in our annotated statutes (State v. Walls, IIRC) that says any weapon in a vehicle that is not easily discernable by someone passing by (so basically, anything not sitting on the dashboard or taped to the window) is concealed. The legislators that wrote our CCW bill meant for OC in cars to be legal without a permit, but the case law really needs to be overturned, as it is from 1995 (before we had a RKBA amendment and before several other firearms laws had changed).

    I call this the natural result of the “reasonable person” standard and the removal of intent from criminal law.
