Shooting at burglar

105 years in prison. Odd story, the man could be out but won’t plead and he’s lost everything.

Update: Charges dropped.

    That sounds pretty damning coming from cops who had just fired 14 rounds at a man. Very strange.

    Funny how the DA went from threatening 105 years to offering 12 months probation to completely dismissing the charges.

    Why, it’s almost as if the DA knew he didn’t have a case!

    The DA is overcharging, but I do think the guy is guilty of the crime, at least if the newspaper account is accurate. This wasn’t a self defense situation.

    Does Georgia have “Castle Doctrine?” Does it have “Premption Laws” (where the Locals can’t make laws tougher than the State Maximum)?

    I’m not sure the castle doctrine would apply to a guy outside, especially since the neighbors accounts make it more like he shot the guy for giving him lip than because he was actually afraid for his life.

    They can’t say that he pointed a gun at them when they weren’t even sure he had a gun on him at the time. I would find in his favor in a heartbeat as a juror, based on only the video, if its description is accurate.

    Damages would be real easy. The value of all of his property that was destroyed, treble it for the sentimental value, another $250K or so for the seven months in jail, and a nice seven figure sum for the kidney.

    The man was within his rights in that state. These cops shot a man for defending his property from a criminal.

    The prosecutor was trying desperately to pin some charge on him, because he knows exactly what kind of lawsuit is a commin’.

    But this dumbass prosecutor applied the screws too hard, and created a person with nothing left to lose.

    From the account it sounds as if the criminal was not actually shot, just “shot at.” The guy defending his property “shot into the dirt.” Seems that was intentional and he was just trying to scare the guy off.

    Of course the stories are not 100% clear on that point, but is seems the guy defending his home and business was the only one actually shot.
