In NC

New NFA laws went into effect. Seems a local sheriff and the AG think that acquiring NFA items via a trust is illegal. But they won’t prosecute. Interesting. Most states ban NFA items and say that having them registered through the NFA process is a defense.

    Our new gun laws which go into effect on 12-1-11 should take care of Bob’s problem. HB650 (or more appropriately now Session Law 2011-268) says that NFA items properly registered under Federal law are exceptions to the ban. It says a Sheriff can still refuse to sign your ATF NFA paperwork but if you are using a gun trust, it is my understanding that the CLEO’s sig is not required.

    So the AG and sherriff are refusing to prosecute what they both say is a crime? I’d say fire ’em both using this excuse.

    Bubblehead: Yes.

    NC has always been a bit squirrely for a supposed southern state.
