I knew when I read a 2nd amendment newt Gingrich support that this guy was batshit nuts… Newt is 2nd amendment solely for the votes and would be a terrible 2nd supporter as president. He is more like a moderate gun control democrat…

The basis of the law are primarily two motivations: fence building and rent seeking. Having all transfers go through FFLs obtains both goals.

If NICS checks are required in a state for a private sale, let anyone use NICS instant check.
If no NICS checks are required, continue with the current practices within the state – whether the private sales take place at a gun show, a car show, a private home, the shooting range, or from the Classifieds.
Problem solved.
Many other suggestions from those who want restrictions on private sales are political, not practical, and can be valued at the current price of heated air.

Criminals will always get guns legally or illegally. We have a criminal problem, not a gun problem. Part of the solution to the criminal problem is to have less or no unarmed victims upon which they prey.
And John Smith is right, why would a self-proclaimed 2nd Amendment activist support Gingrich? The two most pro-gun candidates are Bachmann and Paul. Ron Paul is 100% progun who advocates eliminating the ATF and ALL unconstitutional Federal gun laws. He would also appoint judges who support ALL of the Bill of Rights.

California bans private sales, gun-show or otherwise. It’s been this way for many years. All transfers must proceed via an FFL dealer (with only extremely narrow exceptions). And it doesn’t make one damn bit of difference in the number of so-called “gun deaths”.

We can close the loophole very easily.
Just shut down the ATF! They ARE the loophole!
