All people have a right to keep and bear arms. As Oleg has taught us, it is a HUMAN RIGHT.
I’m not sure if I believe the following, but I’ll toss it out. Check my logic here:
Based on current law, felons cannot legally own guns in America. Illegal immigration is a felony. Therefore illegal immigrants cannot own guns once convicted.
Is it a “Bill of Rights” or a “Bill of Rights that only recognizes certain people born in a specific geographical location”?
I’ve been in the “High Fence and Wide Gate” camp myself for a few decades but this is just wrong. The cornerstone of our government is that rights are present and inalienable in everyone and government gets its powers by consent of the governed.
Odd as it may seem to some who know me well, I’m heavily in the camp of, yes, it is a HUMAN right and therefore he DOES have the RKBA, whether or not he is hear illegally. But as Mischief says above, drop the charges and deport his ass.
I’m more of a High Fence and Narrow Gate camp, but even if he’s convicted of the felony of being here illegally (and yes, my opinion here is in contravention to current law), he still has the pre-existing (i.e.: not dependent on the constitution as the SCOTUS ruled in Heller) RKBA. Sure, take his gun, but ship it back to him (with the consent of his country of origin, of course) AFTER deporting him.
To me this seems correct, possession of arms while committing a serious criminal offense is almost certainly not within the bounds of the Second Amendment.
My first impression is this is probably necessary given the status quo of actual enforcement of immigration laws (or lack thereof). It’s also helpful practically to draw a line between RKBA for legal and illegal immigrants. IF we had good-faith enforcement of border and immigration laws then I might reconsider, but that’s not really a plausible scenario any time soon.
Gee..color me surprised. they do get vocal when they think we(legal immigrants and people born here)are getting in their way when it comes to rights,but its suddenly not fair for us to ask for government issued identification?

Well, I’m willing to come half way and agree that illegal immigration is not treated as a serious offense.
If it was, there would be a double fence with barb wire, earth seismographs, and web enabled cameras strung across Canada too.
Think you’ll get a slap on the wrist and a free ride home if you sneak into Mexico?
