I am going to sue my liquor store for not advising me to stop drinking before I fall down.
One time, I went all Stalone, and shut 120 rounds out of an AK, maybe five seconds apart. Had both earplugs and muffs, but also had the stock welded to my cheekbone. I had a ringing in my right ear for about a week and worried about permanent tinitus, but it went away.

My inner lawyer: This is a nuisance suit. She’ll have a hell of a time proving that the shooting caused her hearing loss. Lots of things could cause hearing problems, including taking aspirin. But the gun shop’s insurance won’t want to spend a ton of money on lawyers. Also, the insurance company has a duty to protect the gun shop’s goodwill (reputation) and make the case go away as soon as possible. Her lawyer won’t want to spend money on $800.00/hr

The problem with this picture has nothting to do with shooting ranges and hearing loss.
It has everything to do with an overabundance of law schools and starving lawyers who will sue anyone for anything or, more often than not, for nothing.
And I think that around 1/3 of practicing lawyers fall into the category of clowns who would institute a suit like this.
The obscene growth of the litigation industry has changed, for the worse, every aspect of society and the way we behave.
When I was young, a swing set or a trampoline was an oversized toy and a lot of fun – now, they are little more than a cause of action.
This case exemplifies the need for “loser pays” legislation in which a losing plaintiff would be required to pay the costs of defense incurred by the defendant, who was found to be not liable.

The Arms Room is one of several “home ranges” I use, and I shoot IDPA there on many a Monday evening.
I can Guar An Damn Tee Ya, that there is no way in hell that they “gave her a loaded gun, and pointed her to the range”. None. Zero.
The fact of which, begs the veracity of any other aspct of the story, or her lawsuit.
I’ve seen new shooters such as herself in there, and they’re absolutely, always accompanied by a rangemaster, who works with ’em long enough to ensure basic safety. If the customer wants true “lessons”, they have classes and instructors there (Tom Estep being one of the best in Galveston County.)
The range was issuing Pro Ears Gold electronic earmuffs to customers needeing ear-pro. Top of the line stuff, that.
