Seems that the DC police cannot confirm TMZ’s source that David Gregory got a get out of jail free card. Now, DC police and ATF are having a back and forth over.
It’s a bit ironic to me that Gregory is now victim of something ATF is famous for: Giving you approval and then later changing its mind.

Read the article; a real journalist could make hay that the supposed firearms regulators do not know gun laws themselves. But then they would have to admit all the gun control laws that do exist.

Prof Jacobson over at Legal Insurrection is doing heavy lifting on this one. He talked to Metro PD and they told him that they told Gregory to not use the magazine.

The feds haven’t surrounded his house, shot his dog and his family, and then burned his house down?
Funny how some people get the “little misunderstanding between friends” treatment when it comes to gun laws, while other people get assassinated.
That’s what passes for “equality under the law”. Some animals are more equal than others. It seems that the outcome depends on whether the government likes you or not, not how the law reads.

If they don’t proscute Gregory, the next black man charged with violating the magazine limit has a great defense that DC’s prohibition is intentionally all-inclusive, and that DC proscutors charge based on race.
It always has been, but at least it will be undniable.

I don’t see how this should work differently for him than anyone else. If I call the ATF and they tell me it’s ok to speed through a school zone, it isn’t going to make a bit of difference. Ignorance also isn’t an excuse. What should be made a point of here is that this is how normally law-abiding citizens become criminals. Gregory’s hypocrisy should be playing second fiddle to everyone making a point of why laws don’t work and how they make citizens into criminals. Also, LaPierre should have called him out on that on national television.

ATF has no authority to waive DC gun laws. It’s also a strict liability offence so it doesn’t matter if permission was granted or not.
