jay, I’ve dealt with the alcohol curve. I don’t see how the average person can get to 0.00 from 0.08 in less than four hours if that soon. I hope he sues them. Sues them hard.
Race definitely doesn’t HAVE to be an issue. I’ve had cops tell me that they figure that 80% of people out after a certain hour are drunk. It’s an assumption, likely from some amount of experience.
It might have been race or it might have been guilt by association (with people out after a certain hour). I have definitely been pulled over late at night, in town, for things that everyone does in the daylight and never get pulled over for doing, such as pulling out of a parking lot without signaling. The officer immediately asks me, not whether I’ve been drinking, but how much. I know the feeling. I’m white, too, and the cops were white, so race might not be any factor at all. We just don’t know without seeing a long term pattern of behavior from these particular cops. I’ve also been guilty of “driving while a concealed carry permit holder”. Yes; I do know the feeling.
