yeah… prosecutors sometimes try to take those to trial. they also try to back extrapolate (a not-unreasonable practice) from 0.000 sometimes (an unreasonable practice).

He was Driving While Black. It’s a lesser included of Being A N***er On A Sunny Day — they couldn’t charge him with that because it was nighttime. “This is madness!” “No, this is Arizona.” At least they did not dress him in pink underwear and torture him to death in a tent.

jay, I’ve dealt with the alcohol curve. I don’t see how the average person can get to 0.00 from 0.08 in less than four hours if that soon. I hope he sues them. Sues them hard.

I don’t see where race has to be an issue. Maybe the cop is just an asshole or authority freak.

Race definitely doesn’t HAVE to be an issue. I’ve had cops tell me that they figure that 80% of people out after a certain hour are drunk. It’s an assumption, likely from some amount of experience.
It might have been race or it might have been guilt by association (with people out after a certain hour). I have definitely been pulled over late at night, in town, for things that everyone does in the daylight and never get pulled over for doing, such as pulling out of a parking lot without signaling. The officer immediately asks me, not whether I’ve been drinking, but how much. I know the feeling. I’m white, too, and the cops were white, so race might not be any factor at all. We just don’t know without seeing a long term pattern of behavior from these particular cops. I’ve also been guilty of “driving while a concealed carry permit holder”. Yes; I do know the feeling.
