Just have police switch to live ammo when the first window gets broken. As far as I’m concerned, that’s when ‘protest’ becomes ‘riot’ and its time to ‘take out’ the trash.
California has a history of blaming objects rather than the people who carry them and actually use them for harm. That’s where their loaded carry and unloaded open carry bans came from.
Failing to disperse can be a crime, but is there really a legal duty to let yourself get shot with rubber bullets while doing so?
If you only intend to use them in legitimate self-defense (which should be the presumption until proven otherwise) should you be forbidden from carrying those implements the powers that be have not yet banned?
I lived in CA for a couple of years in the 90’s but never visited Oakland. It really sounds like an awful place. I left CA altogether in ’94 – it was obvious back then where the state was heading.
I presume that Oakland, like the rest of the country, has laws on the books already about assault with a deadly weapon, vandalism, disorderly conduct and other common crimes.
The new law is unnecessary. Current law covers all aspects of the riotous behavior of protesters.
The only thing this law will do is support a cottage industry of lawsuits against it, as prior restraint is a strong argument against limits on political expression.
interesting to see the antis come out in this thread to defend aggressive policing, pretending that those same cops wouldn’t happily bash heads at a 2A rally. i don’t have any particular sympathy for oakland’s anarchists, but “occupy” folks are closer to tea partiers than most people acknowledge and California is the front lines for constitutional struggles.
Oakland is a Lefty city run by Unions and Socialists who are in favor of the #Occupy crowd because they are a distraction from the usual payola and cronyism – they are Detroit-West, with a Port that makes them profitable as they squeeze the shipping and trucking industry.
