IRS will recognize gay married couples
Over at Volokh, some discussion. I find this odd but not unexpected.

Here in Texas we have (or had, I have not checked lately) a law about common law marriage, with cohabitation for a certain time period being recognizable by the state as meaning you are as much as married. It has to do with palimony lawsuits, where there is a 50% split of all assets from the time together.
The first I learned of this was when Martina Navratilova split with her long-term live-in girlfriend, who sued for what was essentially palimony. The lesbian issue was much less important at the time, as I recall, than the cohabitation & common law marriage issue, compounded by a “prenup” that Martina supposedly violated somehow. They were ready to go to trial when Martina settled the suit out of court.
And they say Texas is behind the times….
