Actually, the statute in question does give the President the authority to waive it in the interests of national security. There are some hoops to jump thropugh, but they are all held by Administration officials, so basically it’s a blank check for the President to nullify the law whenever he wants to.
So the “law” against arming terrorists is merely a symbolic gesture, at best.
