“undercover” either. Most departments make exceptions for undercover work when there is a life safety issue. This is inexcusable.
If they were “off duty”, then they WEREN’T “undercover” at the time. If your cover requires you to maintain it during “social” events, you’re still ON duty.
So the cop who says the reason HE didn;t intervene was he was afraid of blowing his cover is either lying, or just admited that his social friends are the same people he is infiltrating.
If Mieses dies, the cops (as well as the other bikers) should be prosecuted for felony murder.
At least they should be fired. Many states have laws on the books that make it a crime for a LEO who see a crime not to act. If NY has one they should be prosecuted to the fullest.
It’s sad that when I saw all the videos of these asshats riding in packs, blocking roads, and threatening people, my first thought was that “normal” people wouldn’t feel so untouchable, so the group must be filled with off duty cops.
Here is a good math puzzle. If Lien was armed, how many magazines loaded to the New York legal maximum of seven rounds per magazine would be required to stop the threat of the the entire group of bikers? Assume, of course, that the five police officer bikers do not identify themselves as police officers and intervene to stop the threat of the bikers, so that they are also treated as part of the threat posed by the 30 bikers acting in concert. Also assume that three rounds each are needed to stop the threat.

No duty to protect, right? So that’s reprehensible, cause to be fired, etc, etc, but no actual criminal behavior.
OTOH, if any of them were trained in rendering first aid they might be liable under the “good Samaritan” law (as I understand it.)
