I don’t think there’s a provision for using NICS in this way. If there is, we’ll probably do our level best top crash it by purchasing each box on a separate transaction.
Being a former NYer, I can assure you that they do, indeed, have access to NICS.
Being a current Tennessean, one that also has a gun store now (on a side note, COME ON OUT FOLKS! We’re in Oak Ridge, about two and a half miles from ORSA…) it was made VERY clear to me by the ATF agent who gave my final inspection for the FFL, that NICS is only to be used for background checks of firearms (which includes cannons, suppressors, grenades, etc., if you are duly licensed to transact business in such).
Ammunition IS NOT in the list of *what is the purpose of the background check*, and there is no provision on the 4473 for ammo either.
Ergo, New Yorks colossally stupid SAFE debacle is nothing more than wishful thinking. FFLs in that state can refuse to perform ammo background checks, because it would be a violation of Federal Law to use the system in that manner…and they could lose their license over it.
