Sean Penn: Criminal

So, apparently his new girlfriend convinced him to give up his 65 guns. They’ll be melted and made into a shitty sculpture. The question is how does Sean Penn own those 65 guns? Penn has been charged with assault a few times. He plead to misdemeanor domestic assault. That would make him a prohibited person who, by law, cannot own guns. Somebody call the police.

    I’m SURE that Penn and Koons will follow ALL the proper Fed and CA laws regarding firearms transfers, like the CA requirement to transfer all modern firearms through an FFL.

    So what’s new. Look at David Crosby. Served time in Texas on felony drug charges, but gets a finger wagging on firearm (and controlled substance) possession in New York. Like you and me, only better.

    Charges that are no longer active can’t DQ you; that’s a due process violation. It has to be pending, active charges/under indictment, or a conviction.

    If he did have a misdemeanor conviction for domestic abuse he’d be prohibited.

    But the problem is, the only source I can find for that is that same link you give – with no details as to the actual charge, just “a misdemeanor”, which could have been a not-domestic-violence-under-Lautenberg conviction.

    That makes me suspicious, because normally with celebrities you can get details of any charge and specifics about convictions. But everyone – from Wikipedia to other “news” sites to the celebrity gossip rags – seems to just link to that one NY Daily News article for that claim. So I’m dubious.

    Not enough data to say he’d actually be denied on a 4473; probably he isn’t prohibited, is my guess.

    I find the story interesting but I’d really like the name of his lawyer, who apparently knows how to make the legal system sit up and bark like a trained seal despite Mr. Penns colorful personal antics.

    As I believe the whole prohibited person thing is unconstitutional and illegal I have no problem with him owning a gun. I do have a problem with him destroying even one, though.

    Penn definitely had a conviction – I’m thinking it was for assaulting a paparazzi. He served time int the Mono County jail. Friend of mine was his cell mate. Said he was a great guy!

    In other words, Hank — Penn’s conviction was for misdemeanor assault or battery. Not a felony, nor is it a misdemeanor domestic violence charge — so he wouldn’t be a prohibited person.
