It is my firm belief that ‘equal protection under the law’ also means ‘equal enforcement of the law’.
For how can one be equally ‘protected’ of some get off free while others get the book thrown at them.
If I was the guy being prosecuted I’d claim it was a violation of the constitution and take it all the way to the Supreme Court. And get the NRA-ILA and ACLU involved.
Not because it’s a gun right thing but because it’s about equal protection under the law.

But that’s the whole problem here, Paul. We’re rapidly sliding into a dual tier system of high justice and low justice, where the nobles get judged by one set of rules and the commoners get judged by another.
Add to that the fact that the prosecutors and police KNOW this is an unmitigated disaster, and they have motivation to drag it out as long as they can in the hopes that Witaschek throws in the towel due to financial constraints (the state, of course, has no such worries).
This is not going to end well.

Justice for me but not for thee is certainly not what the Founding Fathers had in mind. I hope he appeals all the way to the Supreme Court if convicted.

Unequal enforcement of the law is corruption and the D.C. AG is factually corrupt. The first raid and search of this guy’s house was without a warrant? The second, with a warrant, turned up a dud shotgun shell? The AG should be held personally responsible for the cost, on both sides, of this travesty. Maybe his buddy, Dick Gregory, could give him a job later.

When I lived in Baltimore and worked for a total of 6 years in DC, I tried hard to obey the law about no guns or ammo in the vehicle. As I was shooting about twice a month at the range, it wasn’t particularly difficult to remove everything from the car after a trip to turn money into noise.
But I recall the feeling I had on a few days, as I sped down the Balt-Wash Parkway with thousands of other commuters, when I’d suddenly remember the empty shell casings I meant to clean out of the trunk, or the box of 22LR that I stuffed in the glove compartment from my pocket, or (more than once) the Craftsman Toolbox full of handguns that I left forgotten in the trunk.
I drove significantly more legally on those days than normally, but what else could I do at that point, other than hope I wasn’t stopped with a felony in my trunk, that was merely proper storage for returning from a range trip outside the enclave of DC?
May the city council and the mayor earn the reward they so deeply deserve for their decades of vile behavior.
