PTI is better than imprisonment, and may allow the record to be expunged. But the prosecutor only “offers” it after a “clarification” from the [acting] State AG.
But the PTI program is meant to override environmental factors predisposing people toward criminal actions, which does not seem so appropriate. From a comment on the Reason article about the offer of PTI (http://reason.com/blog/2014/09/24/prosecutor-drops-prison-threat-against-g#comment or http://www.judiciary.state.nj.us/criminal/crpti.htm) –
. The Pretrial Intervention Program (PTI) provides defendants, generally first-time offenders, with opportunities for alternatives to the traditional criminal justice process of ordinary prosecution. PTI seeks to render early rehabilitative services, when such services can reasonably be expected to deter future criminal behavior. The PTI program is based on a rehabilitative model that recognizes that there may be an apparent causal connection between the offense charged and the rehabilitative needs of a defendant. Further, the rehabilitative model emphasizes that social, cultural, and economic conditions often result in a defendant’s decision to commit crime.
.
Simply stated, PTI strives to solve personal problems which tend to result from the conditions that appear to cause crime, and ultimately, to deter future criminal or disorderly behavior by a defendant.”
I’m thinking this is more about preserving their precious gun laws. They are probably worried about having a defendant like Allen (with the help of SAF hopefully) taking them all the way to the supreme court. I’m glad for Ms. Allen though.
Now, WTF is pre-trial intervention? If this isn’t a crime, then repeal or fix the stupid law. If it is a crime, then prosecute to the hilt.
So NJ is going to spend time & money on publicly condemning a woman whose only misdeed was to be in New Jersey while exercising a right? Makes sense to me.
Stay the hell out of New Jersey.
And Chris Christie still has a pardon he should be using here. If he doesn’t, fuck him and the horse he ate.

So the prosecutor and the Attorney General “clarified” an earlier directive.
In plain language: “We are copping heat for this, find a way to make it alright, without looking like we backed down.”

Exactly. It’s common sense: pity it took this long for the oligarchs in NJ to decide to use some.
