To commit common use, I’d argue that any manufacturer offering their firearm to FFLs online or directly, across multiple states or within one state, qualifies. I’d also argue that anyone making custom firearms demonstrates common use by having two other people possess examples.
Let’s get the definitions settled before anyone tries writing into law more Catch-22s about AR15s being uncommon, or a new design being illegal.
1839? Holy cow, so what particular gun is that? “Raising” the breech cocks it and it’s ready when the breech is lowered. Curious.
mikee; What is or is not “in common use” is beside the point. The point is that trying to invent a “common use” clause, as a means of infringing on the right to keep and bear arms, is a criminal offense. The perpetrators have already openly declared themselves, and so all that’s left is to prosecute them.
We often sound like a bunch of German Jews fussing over what is and is not an acceptably clean, and acceptably yellow, Star of David arm band as we approach the loading dock to get onto the cattle cars. Surely we’ll be alright once we have established, once and for all, exactly what is the proper arm band.
