Re-ban, they mean, since they’re already banned (as Reynolds notes in his addendum, and I point out with reference to 18USC922 in the comments).
I think Rep. Israel doesn’t even realize that his political theater has already been performed.

(I mean, he says “To combat this problem, Israel’s legislation would mandate that a major component of each gun be made of metal and that the weapon would be inoperable without that component.”.
But that’s a non-“problem”, since in fact nobody has ever done such a thing because a “totally plastic gun” is worthless.
His other problem, of course, is that such a “major component”, such as a barrel or a block, could still be removable, and the gun inoperable while it’s gone … while also easy to re-attach once through security.
It’s pointless.)

Flare guns aren’t “weapons” under 18 USC 921, so modifying 18 USC 922 – which is what I take his “modernization act” to do – wouldn’t affect them.
This according to both plain reading [the statute does not define “weapon” specifically, thus leaving us with normal usage] and both court cases and ATF decisions.
Flare guns are not intended to – and in normal unmodified use cannot – fire normal offensive ammunition, and are thus not “weapons” even though they do fit the rest of the definition, since they do fire an object via the explosion of powder.
(Just as a nail gun is not a firearm under 18 USC 921, despite making a nail move by exploding gunpowder.
Not designed or modified for use as a weapon, not a weapon.)
