Second Circuit Mostly Upholds SAFE Act

I concur, it’s not much of a surprise given the circuit’s past decisions on gun control (hint, they like it).

    Basically they said nothing is protected. Even though they overturned the ban on pump-action rifles, they basically said come back and try later after a crime gets committed and we’ll let you ban that, too.

    Only a Congressionally passed ban on laws more restrictive than federal law or a new constitutional amendment will change this.

    Heller means nothing. The dicta therein, that Heller was not answering questions about the constitutionality of anything other than an outright ban on handguns, and that thus all other gun laws were not affected by Heller, has come to be read as saying all other gun laws are constitutional.

    Up is down, hot is cold, cats are dogs and the constitution does nothing to protect rights.

    Maxpwr, if read objectively according to the rules of English grammar and in context, the 10th Amendment should ban any gun laws applicable to the people because it restricts the Federal Government to only its delegated powers. But then, rogue lawlessness and criminality by government officials and judges is the problem.

    I would like to agree, but the 9th and 10th Amendments get about 1% more respect than the 2nd Amendment. Everything has been downhill since Marbury v. Madison. America was a heck of a run while it lasted.
