Wouldn’t that be the DEA? But both agencies are unconstitutional since the Federal Govdrnment has no delegated powers over drugs, alcohol, tobacco or firearms EXCEPT over “such part of the militia ” that it EMPLOYS. (Article I, Section 8.16). According to the 10th Amendment, the Federal Government may go NOTHING without delegated powers.

@Ron, I’m guessing they added the updated language because in 11e you have to attest that you are or are not an unlawful user of drugs. They are reminding everyone that at a federal level, marijuana is still illegal even if it is legal at the state level – so you would have to answer “yes” still.

If it is still illegal at a federal level then how and why is it “legal” at a state level?
The 4473 then becomes a contradiction of itself. Either the federal gov enforces all drug laws in every state or they enforce nothing.

I’ll tell you what’s a federal crime. It’s a federal crime to deprive rights under color of law, or to conspire to deprive rights. Those two take precedence in my book, I say to those of you in the Bureau, so don’t YOU go presuming to remind ME of what’s criminal. You’re in no position to speak. Just because we’ve tolerated your abuses for this long doesn’t mean you’re free and clear. Far from it. Your abuses are piling up and we’re keeping a record.

It is simple. If nobody knows what the laws are, or what laws are in force in a region, we all are lawbreakers. That means they can arrest any of us if they feel like it. As far as the Fed is concerned, that’s not a bug — it’s a feature.

The 4473 asks if you are in the U.S. Illegally. So with the current non enforcement, shouldn’t that be removed? And may an illegal alien, oh, excuse me, undocumented resident, buy a gun legally in a sanctuary city or just skip that question?
