In Alabama, an 11 year old shot a burglar then made fun of him for crying like a baby:
Gaither said he was scared, but wanted to be prepared so he grabbed a nine-millimeter hand gun.
When he was coming down the stairs, thats when he told me he was going to kill me, f-you and all that, Gaither said.
The intruder made it out the front door with a hamper in hand.
Thats when Gaither started firing off bullets. As the intruder was about to jump a fence in the front yard, Gaithers 12th and final shot hit the suspect in the leg.
Not sure the particulars of Alabama law but shooting a fleeing burglar is, typically, not considered self defense. If he’d shot him when he was being threatened though . . .

Yeah, the reporting on this is, unsurprisingly, atrocious. Either the reporter left out some important details between “coming down the stairs” and “made it out the front door” and “about to jump the fence” or this kids story is rather suspicious.

It would be legal in Texas. Except in Dallas or Houston, his parents might get charged with “allowing access to a gun to a child”.

The kid fired “booooh” lets at the perp. Finally hitting him in the leg. Nice. Those are the best “lets” to fire.
Stopped to spend a night in Alabama a few years back whilst on a motorcycle trip with a friend. Nice enough town. Asked the hotel clerk what the main industry was.
“Meth.” she replied without a hint of irony. 20 minutes later we found ourselves trying to outrun a pimp in a 15 year old caddy because we yelled at him after he cut us off at an intersection.
Nice place. Not going back.

If the intruder really said he was going to kill the kid, and the kid believed he was coming back… Sounds like a credible threat to me. And I seriously doubt an Alabama jury would find fault with that argument.

The ‘reasonable man’ argument should not extend to a child. It would be incredibly easy for a lawyer to make the case that a child was in fear for his life… even while the guy was running away.

FiftyCalTX, the young man’s actions would not just be legal, but commended, in Texas. Even if his folks faced abusive prosecution in Dallas or Houston, public opinion would be with him, firmly.
